MAJESKE HOME INSPECTION SERVICES PRE-INSPECTION CONTRACT

  If the client is not present during the inspection, acceptance and use of the report provided constitutes total agreement with all aspects of the following contract.

This home inspection is performed in accordance with the Standards of Practice of the International Association of Certified Home Inspectors (which can be viewed at http://www.nachi.org/sopintro.htm) and is an examination of the mechanical and physical components of real property identified on page 1 of this report, as they exist at the date and time of the inspection only through visual means and operation of normal user controls.  The home inspector does not possess licenses authorizing the rendering of detailed opinions regarding all of the systems, structures, and components of a building.  The results of this home inspection are not intended to make any representation regarding latent or concealed defects that may exist, and no warranty or guarantee is expressed or implied.  ACCORDINGLY, MAJESKE HOME INSPECTION SERVICES® HERBY DISCLAIMS ANY AND ALL WARRANTIES NOT STATED IN THIS CONTRACT.            

Note:  Condo inspections are primarily an interior inspection and limited to interior components only.

What We Do:

1.       We perform a visual inspection in a good and workmanlike manner.

2.       We tell you whether each item we inspect is performing the function for which it was intended or is in need of immediate repair based on the professional opinion of Mark Majeske of Majeske Home Inspection Services®.

What We Do Not Do:

1.       We do not make guarantees, representations or insure the performance or condition of any item after the date and time of this inspection.  If you want a warranty, guarantee or insurance policy, it must be obtained from a warranty or insurance company.  Please remember that almost every component in any house, except new construction, is in used condition and has ordinary wear and tear and does not necessarily operate as it would if it were new. Normal wear and tear cosmetic deficiencies are not recorded or noted in the report.

2.       We do not inspect any item that we cannot see in a normal inspection.  For example, we do not move furniture, floor or wall coverings, or other furnishings.  We do not inspect buried pipes or wiring.  We cannot see items covered by walls or flooring or that is difficult to access.  Repairs, painting or remodeling may hide evidence of prior damage or defects.  We do not dismantle equipment to inspect component parts.  We do suggest that you ask the owner about repairs, covered up items or previous problems.

3.       We do not inspect for formaldehyde, lead, asbestos or other environmental hazards.

4.       We do not inspect for building codes, soil analysis, gas leaks, and adequacy of design, capacity, efficiency, size, value, flood plain, pollution or habitability.  Please remember that older houses do not meet the same standard as newer houses even though items in both might be performing functions for which they are intended.

5.       We do not hold ourselves out to be specialists for any particular item.  We are a general real estate inspection company.  If we report that an item is not performing its intended function, needs repair, or any other comment, we urge you to have that item examined by a specialist before purchasing the property.  We do not give estimates as to the cost to repair any item.

6.        EVALUATION OF INSECT INFESTATION (PRESENT OR PAST), AND/OR TOXIC MOLD AND MOLD LIKE SUBSTANCES ARE BEYOND THE SCOPE OF THIS INSPECTION.

What the Client Must Do:

1.       Client must notify us in writing (P.O. Box 484, Holt, Michigan, 48842) of any complaints, concerns or problems regarding our inspection within fourteen (14) days after receipt of our report.

2.       If we report that an item is in need of immediate repair or is not performing its intended function and Client intends to purchase the property anyway, we recommend that Client have that item examined by a specialist first.

3.       It is agreed by all parties that any claim for breach of this contract including any errors and omissions and associated claim for damage, repair or failure to perform or inform are limited to the amount of the inspection fee.

4.       If Client sues on this contract for any reason the Client agrees to pay all of our attorney fees and losts. 

5.       Client acknowledges that the inspector has not made any oral representations that differ from or modify what is written in this contract.

6.       Client must not allow anyone else to use or rely on this report.

In the event of a claim, the Client will allow the Majeske Home Inspection Services® to inspect the claim PRIOR TO ANY REPAIRS or the client will waive the right to make the claim.  Client agrees not to disturb or have repaired anything that may constitute evidence relating to the complaint, except in the case of any emergency.

I, THE  CLIENT OR CLIENT REPRESENTATIVE HAVE READ ALL THE INFORMATION IN THIS CONTRACT AND I UNDERSTAND AND AGREE WITH ALL OF THE LIMITATIONS AND CONTRACT REQUIREMENTS LISTED ABOVE.  I UNDERSTAND THAT THIS DOCUMENT IS THE ENTIRE AGREEMENT AND CONSTITUTES ALL ASPECTS OF THE CONTRACT. THE INSPECTION AND REPORT ARE NOT INTENDED TO BE TECHNICALLY EXHAUSTIVE, OR TO IMPLY THAT EVERY COMPONENT WAS INSPECTED, OR THE EVERY POSSIBLE DEFECT WAS DISCOVERED.
